About Yap State Court
The judicial power of Yap is vested in the Yap State Court, which was certified in 1982. The State Court is comprised of the trial and appellate divisions. The trial division has original jurisdiction over most civil and criminal matters, and the appellate division has the jurisdiction to review all decisions of the trial division.
The Yap State Court routinely hears civil, criminal, small claims, and traffic cases. Additionally, the Yap State Court handles petitions relating to probate, name change, adoption, guardianship, and marriage, among other things.
Organization of the Yap State Court
The Yap State Court consists of four offices, and its organization is set forth in the Organizational Chart.
Office of the Clerk of Courts Services
In addition to providing support to the Office of the Justices and Office of Court Administration, the Office of the Clerk of Courts provides many services to the public. These services include birth certificate access, notary services, marriage and dissolution forms, and information on filing small claims cases.
A 2015 compilation of the Yap State Court Rules can be downloaded here. This is the second comprehensive collection of the state court's rules since 1982. General Court Orders Compilation 2015
The Yap State Court has updated its compilation of its issued General Court Orders. This compilation can be found in one, easy-to-access document. General Court Orders are the mechanisms by which the Yap State Court exercises its rulemaking authority. The court’s rulemaking authority is vested both in the Yap State Constitution, Article VII, Section 6, and the Yap State Code, 4 Y.S.C. § 182. Hyperlinks and Table of Contents Added to the Rules of Small Claims Procedure for the State Court of Yap
Colonia, Yap (Yap State Court Press Release, April 23, 2018) – The Yap State Court has recently added a table of contents and hyperlinks to its Rules of Small Claims Procedure. Internal links within the newly created table of contents allow a user to quickly access the full text of a particular rule, eliminating the need to scroll through the document.
In the near future, the Yap State Court plans to add hyperlinks to sets of court rules that do not yet have them. Once this is completed, all court rules will be arranged into one user-friendly, easy-to-access document and will be available on the Yap State Court’s webpage. The public will be notified when this occurs.
